Terms of Service

1. Acceptance of Terms

By accessing or using SEESOUND (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

SEESOUND is operated by the SEESOUND project. References to “we,” “us,” or “our” refer to the SEESOUND project and its maintainers.

2. Description of Service

SEESOUND is a browser-based music visualizer platform that allows users to load audio tracks and generate real-time visuals. The Service includes:

  • A free, interactive visualizer running in the browser.
  • Premium features including server-side video rendering and stem splitting (audio source separation).
  • Educational content about music visualization theory.

3. Accounts

To access premium features, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must provide accurate and complete information when creating your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

4. Subscriptions and Payments

SEESOUND Premium is offered as a subscription. Subscription fees are processed through Stripe and are billed on a recurring basis as described at the time of purchase. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

All fees are in U.S. dollars and are non-refundable except as required by applicable law. We reserve the right to change subscription pricing with reasonable notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload audio content that infringes third-party intellectual property rights.
  • Attempt to circumvent usage limits, paywalls, or security measures.
  • Use the Service to distribute malware, spam, or harmful content.
  • Reverse-engineer, decompile, or extract the source code of the Service except as permitted by open-source licenses.
  • Use automated means (bots, scrapers) to access the Service without permission.

6. Intellectual Property

The SEESOUND engine is open-source software available under its respective license at GitHub. The SEESOUND name, logo, and branding are proprietary and may not be used without permission.

You retain ownership of audio content you upload. By uploading content, you grant us a limited license to process that content solely for the purpose of providing the Service to you (e.g., rendering visuals, splitting stems).

Visual outputs (rendered videos) generated by the Service are yours to use as you wish, subject to any rights in the underlying audio.

7. Third-Party Services

SEESOUND integrates with third-party services including Google (authentication), Stripe (payments), Turso (database), Modal (compute), and Google Analytics. Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. Render jobs and stem-splitting may be subject to compute availability and processing queues.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEESOUND AND ITS MAINTAINERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR SERVICE INTERRUPTION.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your access to the Service at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us. Data retention after termination is governed by our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
